Deferred applications for all PG.Dip & LLM students must be submitted to Anzolette Saville (anzolette.saville@wits.ac.za).\n\n1.2.\tApplications must be submitted within 3 working days from the date on which the assessment was written or due, except where the student is still experiencing the illness or event which led to the application for a deferred assessment.\n\n1.3.\tIf a student is unable to complete the deferred application within 3 working days, the student must provide supporting documents which adequately motivate her or his failure to adhere to the deadline. Without such supporting documents, late applications will not be considered.\n\n1.4.\tApplications must be accompanied by supporting documents which provide relevant and sufficient proof that the student qualifies for a deferred assessment. These documents must be submitted electronically together with the application for deferred assessments.\n\n1.5.\tApplications for late handing in of assignments and take-home tests are treated in the same manner as other deferred applications, but students must submit their late assignments or tests to the course coordinator as soon as possible after the deadline, and may not withhold their tests or assignments pending the outcome of the deferred application process.\n\n1.6.\tIf a deferred application is successful, course coordinators determine whether the student should write a deferred assessment, whether the student will be excused from the assessment or whether the late submission will be marked.\n\n2.\tCriteria for granting a deferred application\n\n2.1.\tDeferred applications are dealt with by a committee of academic and professional staff from the School in accordance with item 1.17 of the Senate Policy on the Assessment of Student Learning (General Rule 13.6).\n\n3.\tIllness during the course of an assessment\n\n3.1.\tA student who has completed an assessment while ill may not subsequently produce a medical certificate in an attempt to have the outcome of the assessment disregarded.\n\n3.2.\tA student who falls ill during a contact assessment must report immediately to the chief or senior invigilator who will arrange for her or him to be accompanied to the Campus Health and Wellness Centre (CHWC) to be assessed and treated. The CHWC must issue a medical certificate if the student is unable to complete the assessment and the student will be granted a deferred on the basis of such a certificate.\n\n4.\tIllness arising before the assessment\n\n4.1.\tA student who falls ill before an assessment, or during an online or take-home assessment must produce a medical certificate which provides evidence of a serious impediment to the student’s ability to complete or prepare for the assessment. Alternatively, a student may also hand in a standard medical form available from the Student Self-Service Portal, completed by a medical practitioner.\n\n4.2.\tThe medical certificate must contain:\n\n4.2.1.\tThe name, practice number and contact details of the medical practitioner;\n\n4.2.2.\tAn indication that the student was examined by the medical practitioner and found to have been ill at the relevant time;\n\n4.2.3.\tAn indication of the nature of the illness suffered by the student or a description of the nature and severity of the symptoms suffered as a result of the ailment.\n\n4.2.4.\tIf a student wishes to assert her or his right to confidentiality about the nature of their illness, they may do so. In such a case the medical certificate must give an indication of the nature and severity of the symptoms which prevented the student from either sitting or preparing for the assessment.\n\n4.3.\tA medical practitioner may not refuse to disclose the nature of the illness where the student does not assert her or his right to confidentiality. The right to confidentiality is that of the patient and not that of the medical practitioner. In such a case the committee will contact the medical practitioner for further information and may report the medical practitioner to the relevant professional body for disciplinary steps.\n\n5.\tUnacceptable reasons for deferred applications\n\n5.1.\tThe committee will not accept a medical certificate which only indicates that the student suffered from a ‘medical condition,’ ‘illness’ or similarly vague ground.\n\n5.2.\tThe committee will not accept a medical certificate which, instead of indicating that the medical practitioner has examined the student and found her or him to be ill, indicates that the student reported having been ill. This does not constitute evidence of illness.\n\n5.3.\tThe committee will not accept a medical certificate provided by medical practitioners who are family members or friends of the student applying for a deferred assessment.\n\n5.4.\tThe Law School will investigate and may report medical practitioners who appear repeatedly to issue unsubstantiated medical certificates. The Law School will investigate and lay criminal charges against people who fraudulently issue medical certificates without being registered as medical practitioners.\n\n5.5.\tIn cases where acute anxiety produces illness, a deferred assessment may be granted on the first occasion that this occurs, but the candidate must be informed that unless he or she undertakes the course of treatment offered by the Counselling and Careers Development Unit (CCDU), no further such deferments will be granted.\n\n5.6.\tIf a student was previously granted a deferment and failed to present him or herself for the deferred assessment, and also failed to provide an explanation acceptable to the committee for his or her absence, then that applicant may not be granted a deferment on any future occasion.\n\n6.\tDeath of family members\n\n6.1.\tWhile the School has great sympathy for students who suffer the trauma of losing relatives during their studies, such reasons should not be exploited to obtain an unfair advantage over other students.\n\n6.2.\tWhere the application is based on the need to deal with death or to attend a funeral, the School requires a certified copy of a death certificate.\n\n6.3.\tOnly death of close relatives such as parents, grandparents, siblings and children will be considered. If a student wishes to argue that the death of a person other than a close relative should be considered as basis for a deferred application, the School requires an affidavit explaining the nature of the relationship between the deceased person and the student.\n\n7.\tIllness of close family members\n\n7.1.\tStudents may apply for deferred assessments on the basis of the serious illness of close family members. In such cases, the School requires a medical certificate indicating the nature of the illness of the relative, which complies with the criteria for medical certificates as set out above.\n\n8.\tSporting or cultural commitments\n\n8.1.\tA student who has been selected to participate in a sporting, cultural or similar event as a formal representative of the University, province or country, or in a capacity considered equivalent by the committee may be granted a deferred assessment. The committee will consider, inter alia, whether the timing of such an event would constitute a serious impediment to the student’s presence at the assessment and/or the student’s ability to prepare for the assessment.\n\n9.\tReligious grounds\n\n9.1.\tA student who objects to taking an assessment on a hold day of her particular faith should submit a letter of support from the religious leader of that faith.\n\n9.2.\tIn deciding whether or not to grant a deferred, the committee will consider whether the timing of the religious event would constitute a serious impediment to the student’s presence at the assessment and/or the student’s ability to prepare for the assessment.\n\n10.\tWork commitments\n\n10.1.\tWhile the School understands that some students undertake part-time employment to fund their studies, the LLB is a full-time qualification and working students cannot use their work commitments to motivate for a deferred application. Students should prioritise their studies and postpone or reschedule work commitments which clash with University assessments.\n\n10.2.\tStudents who are enrolled with Wits Plus are not full time students and may apply for deferred assessments on the basis of work commitments if they provide letters of support from their employers which indicate the nature and duration of the work event and the reasons why the particular student is required to attend.\n\n11.\tAttendance of social functions\n\n11.1.\tAttendance of social functions, including weddings and social travel abroad or within the country will not constitute sufficient reason for a deferred application to be granted.\n\n12.\tMisreading the assessment information\n\n12.1.\tSave in exceptional circumstances, nothing can be done for a student who misreads the assessment timetable.\n\n13.\tTechnology-related impediments\n\n13.1.\tTechnology-related impediments will only constitute sufficient reason for a deferred application to be granted in the following circumstances:\n\n13.1.1.\tInsufficient access to data: All online assessments in the School of Law are conducted through, or require submission to an Ulwazi site. As all students are able to browse the Ulwazi site without incurring charges on the four major cellphone networks (Cell C; MTN; Telkom; and Vodacom), having no access to data will generally be an insufficient reason for being granted a deferred application. Should an assessment require access to a non-zero rated site, insufficient access to data may constitute sufficient reason for granting a deferred application, but a student must provide proof of having insufficient data (for example by using a screenshot) during the period of assessment.\n\n13.1.2.\tInadequate cellphone reception: A lack of adequate cellphone reception may constitute sufficient reason for granting a deferred application, but a student must provide proof of having lost this reception (for example by using a screenshot), which will be checked against the student’s login records on Ulwazi.\n\n13.1.3.\tFaulty or stolen technology: Fault or stolen technology may constitute sufficient reason for granting a deferred application, but a student must submit a police report or, at a minimum, submit an affidavit detailing the circumstances in which the technology is stolen or faulty. If faulty technology is the reason for the deferment, the School may require proof that there has been some attempt to repair the technology (for example: an email from a repair shop advising they are attending to the technology and specifying what some and/or all of the identified faults are).\n\n13.1.4.\tFaulty Ulwazi: Faulty access to Ulwazi may constitute sufficient reason for granting a deferred application, but a student must submit proof of this fault (for example by using a screenshot), and must demonstrate proof of having reported the problem to Wits ICT, as well as proof of having communicated the problem to the course coordinator concerned.\n\n13.1.5.\tLoad Shedding: Load Shedding may constitute sufficient reason for granting a deferred application, but a student must provide proof from their local municipality or Eskom that power was cut for at least a third of the total time duration of the assessment.\n\n13.2.\tAny screenshots used in support of a deferred application must contain a date and a time stamp indicating the date and the time at which the screen shot was captured. This can be in the format of the date and time either being reflected on the screen itself, or it can be reflected in the original file name.\n\n14.\tOther grounds for deferred assessments\n\n14.1.\tAn application for a deferred assessment on grounds other than those listed above must be accompanied by relevant supportive documentation and sworn statements and will be considered on their merits.\n\n15.\tAppeals\n\n15.1.\tIf a deferred application is not successful, a student may appeal to the Head of School, provided:\n\n15.1.1.\tSuch an appeal must be lodged within one working day of the outcome of the decision; and\n\n15.1.2.\tStudents must indicate that they are lodging an appeal and they will be able to lodge additional documents for consideration with the Head of School.\n\n15.2.\tThe Appeal for LLB courses must be lodged with the administrator responsible for your course. Appeals for PG Dip & LLM students must be lodged with Anzolette Saville at anzolette.saville@wits.ac.za.\n\n15.3.\tThe Head of School will decide whether or not to grant the appeal in accordance with the relevant provisions of the Senate Standing Orders on Assessment of Student Learning.\n\n16.\tStudents who abuse the deferred application process\n\n16.1.\tIn considering an application for deferment, the committee should take into account inter alia, the academic record of the applicant and the history of any previous applications for deferred assessments. If a pattern of deferment requests is observed, which may give rise for concern; this must be investigated by the Faculty Registrar. If no legitimate reasons are discovered, then students may be refused any further deferments.\n\n16.2.\tThe Law School takes an extremely serious view of law students who abuse the deferred application process by knowingly submitting false information, including bogus medical certificates and sworn affidavits. Such students will be referred to the University disciplinary processes and, in cases of dishonest or fraudulent behavior by students, the School may refuse to certify that they are fit and proper persons to practice law.\n\n16.3.\tStudents should note that the application to register articles of clerkship with the Law Society would require them to state whether they have been convicted by the University of any disciplinary offences. A successful disciplinary process on the basis of dishonest or fraudulent abuse of the deferred application process would qualify as such an offense and should be disclosed. When asked for a letter to certify that a student is fit and proper to practice law, the School discloses successful disciplinary proceedings against a student, including infringements relating to the
