STATUTE

TheCounciloftheUniversityoftheWitwatersrand,Johannesburg,hasmadetheStatute,setoutintheSchedulehereto,inaccordancewithsection32oftheHigherEducationAct,1997(ActNo.1010f1997),whichisintermsoftheprovisionsofsection33ofthesaidAct,herebypublishedwiththeapprovaloftheMinisterofEducation,andwhichcomesintooperationonthedateofthispublication.

SCHEDULE

TointroduceanewStatutefortheUniversityoftheWitwatersrand,Johannesburg,togiveeffecttoanylawrelatingtotheUniversity;andtopromotetheeffectiveandresponsiblemanagementandgovernanceoftheUniversityinrespectofmattersnoexpresslyprescribedbyanylaw.

DEFINITIONS

Definitions

1.InthisStatuteanywordorexpressiontowhichameaninghasbeenassignedbytheHigherEducationAct,1997(ActNo.101of1997),hasthemeaningsoassignedtoit,and,unlessthecontextotherwiseindicates,
    "academicemployee"meansanypersonappointedbythecounciltoateachingorresearchpostattheUniversityandanyotheremployeedesignatedassuchbythecouncilandincludesapersoninthiscategorywhoisseeingaprobationaryperiodintermsofhisorhercontractofemploymentpriortopermanentappointment;

    "convocation"meanstheconvocationcontemplatedinparagraph35;

    "council"meansthecouncilcontemplatedinparagraph16;

    "days"includesSaturdays,Sundaysandpublicholidays;

    "donor"meansapersonwhohasmadeadonation,which,intheopinionofthecouncilwarrantsthatpersonbeingrecognisedasadonor;

    "functions"includepowersanddutiesandviceversa;

    "graduate"meansapersonuponwhomadegreehasbeenconferredbyauniversity;

    "month"meansacalendarmonth;

    "PGA"meansthepostgraduatestudentsassociationoftheUniversity;

    "professor"meansanacademicemployeeonthepermanentortemporary,full-timeorpart-time,salariedorhonorarystaffoftheUniversitywhohasbeengiventhetitleofprofessorbytheUniversity,andincludesapersoninanyofthesecategorieswhoisservingaprobationaryperiodintermsofhisorhercontractofservicepriortopermanentappointment,butdoesnotincludeanemeritus,adjunct,associateorassistantprofessor,orareader;

    "Rules"meansanyrulesoftheUniversitymadeundersection32oftheHigherEducationAct;

    "senate"meansthesenatecontemplatedinparagraph29;

    "SRC"meansthestudentsrepresentativecounciloftheUniversity;

    "student"meansanypersonregisteredattheUniversityfull-timeorpart-timeforadegree,diploma,licentiateorcertificateoftheUniversityorregisteredorenrolledforanycourseorprogrammeofinstructionoftheUniversity,providedthatapersonsoregisteredorenrolledwhoisalsoafulltimeorpart-timeemployeeoftheUniversityisnotastudentforthepurposeofmembershipofthecouncilorthesenate;

    "supportservicesemployee"meansapersononthepermanentortemporary,full-timeorpart-timestaffoftheUniversity,otherthananacademicemployee,andincludesapersoninthiscategorywhoisservingaprobationaryperiodintermsofhisorhercontractofservicepriortopermanentappointment;

    "theHigherEducationAct"meanstheHigherEducationAct,1997(ActNo.101of1997);

    "themanagementoftheUniversity"forthepurposesofparagraph43(2)ofthisStatuteandsection31(2)(a)oftheHigherEducationAct,meansabodywhosemembersaretheprincipal,thevice-principal,thedeputyvicechancellorordeputyvice-chancellors,theexecutivedirectororexecutivedirectors,theregistrarorregistrarsandthedeansofthefaculties;

    "theseatoftheUniversity"forthepurposesofparagraph2ofthisStatuteandsection65AoftheHigherEducationActmeansthephysicallocationoftheUniversitywhichisJohannesburgintheGautengProvince;

    "theseniormanagementoftheUniversity"forthepurposesofparagraph43(12)ofthisStatuteandsection31(1)(a)oftheHigherEducationAct,meansabodywhosemembersaretheprincipal,thevice-principal,thedeputyvice-chancellorordeputyvice-chancellors,theexecutivedirectororexecutivedirectorsandtheregistrarorregistrars;

    "theUniversity"meanstheUniversityoftheWitwatersrand,Johannesburg,establishedbytheUniversityoftheWitwatersrand,Johannesburg,(Private)Act,1921(ActNo.15of1921),nowdeemedtobeauniversityestablishedintermsoftheHigherEducationAct;

    "Universityforum"forthepurposesofparagraph43ofthisStatuteandsection31oftheHigherEducationAct,meanstheUniversitysinstitutionalforum.
UNIVERSITY

Name,status,physicallocationandpowersofUniversity

2.(1)ThenameoftheUniversityistheUniversityoftheWitwatersrand,Johannesburg.
    (2)TheUniversityisajuristicperson,theactivitiesofwhichareprincipallyadministeredfromJohannesburginGautengProvinceand,subjecttotheHigherEducationAct,iscapableofperformingsuchactsasjuristicpersonsmaybylawperform.

    (3)Notwithstandingsubparagraph(2),theUniversitymaynot,withouttheconcurrenceoftheMinister,disposeoforalienateinanymanner,anyimmovablepropertyacquiredwiththefinancialassistanceoftheStateorgranttoanypersonanyrealrightthereinorservitudethereon.

3.(1)TheUniversityconsistsof

      (a)thechancellor;

      (b)theprincipal,withinthemeaningofsection30oftheHigherEducationAct,whoiscalledthevice-chancellorandprincipal;

      (c)thevice-principal;

      (d)twoormoreofficers,asthecouncilmaydetermine,eachofwhomiscalleddeputyvice-chancellor,orothersuchtitleasthecouncilmaydetermine,andoneofwhommaybethevice-principal;

      (e)oneormoreregistrarsasdeterminedbythecouncil;

      (f)thecouncil;

      (g)thesenate;

      (h)theuniversityforum;

      (i)theconvocation;

      (j)thepresidentoftheconvocation;

      (k)thefaculties,departmentsandsuchotheracademicstructuresoftheUniversityasmaybedeterminedbythecouncilinaccordancewiththisStatute;

      (l)theacademicemployeesoftheUniversity;

      (m)thesupportservicesemployeesoftheUniversity;

      (n)thestudentsoftheUniversity;and

      (o)thestudentsrepresentativecouncil.

  • (2)Novacancyinanyoftheofficescontemplatedinsubparagraph(1)noranydeficiencyinthenumbersordefectinthecompositionofthebodiescontemplatedinsubparagraph(1)impairsoraffectstheexistenceoftheUniversityasajuristicpersonorany-functionconferredbythisStatuteortheHigherEducationActupontheUniversity

4.(1)ThechancelloristhetitularheadoftheUniversityandinthenameoftheUniversityconfersalldegrees.
    (2)Thechancellorperformssuchotherfunctionsasassignedtohimorherbythecouncil.
Electionofchancellor

5.Thechancelloriselectedbytheconvocationinthefollowingmanner
    (a)thesecretarytotheconvocationfixesaclosingdateforthereturnofvotingpapersandsendsnoticescallingfornominationsfortheelectionofachancellor;

    (b)thenoticesfornominationscontemplatedinsubparagraph(a)aresenttoallenrolledmembersoftheconvocationatleastnineweeksbeforetheclosingdatecontemplatedinsubparagraph(a);

    (c)nominationsinwritingtogetherwithwrittenacceptanceofsuchnominationsmustbelodgedwiththesecretarytotheconvocationatleastsevenweeksbeforetheclosingdatecontemplatedinsubparagraph(a)andeachnominationmustbesignedbyatleastfourmembersoftheconvocation;

6.   (1)Thechancellorholdsofficeforaperiodofsixyears,unlessheorsheresignsorheorsheisdismissed.
    (2)(a)Apersonmaynotbeelectedformorethantwoperiodsofoffice.(b)Theseperiodsofofficemaybeconsecutive.

    (3)Wheneveranelectiontotheofficeofchancelloroccursinayearinwhichnoelectionsbytheconvocationarescheduled,theperiodofofficeoftheincumbentchancellorwillbeextendedbyoneadditionalyear.

    (4)Ifthechancellorisunable,foranyreason,toperformthefunctionsofhisorheroffice,oriftheofficeofchancellorbecomesvacant,theprincipalorthevice-principalperformsthefunctionsofthechancellor.

    (5)Thechancellormayberemovedfromofficebyaresolutionpassedbyatleasttwo-thirdsofthemembersofcouncil.

    (6)Theresolutionmaynotbepassedifthechancellorhasnotbeengiventheopportunitytospeak.

7.   (1)Theprincipalisalsothevice-chancellor.
    (2)TheprincipalisresponsibleforthemanagementandadministrationoftheUniversityandhasallthepowersnecessarytoperformthesefunctionsincludingthepowertoappointactingregistrars,actingdeansoffaculties,actingheadsofschoolsanddepartments,actingchairpersonsofgoverningcommitteesandactingheadsofanyacademicstructurewhichthecouncilmayfromtimetotimedetermine.

    (3)TheprincipalisthechiefexecutiveofficeroftheUniversityandchairpersonofthesenate,andisamemberofallcommitteesofthecouncilandthesenate,andofalljointcommitteesofthecouncilandthesenate.

    (4)Theprincipalisaccountabletothecouncil.

    (5)Iftheprincipalisunable,foranyreason,toperformhisorherfunctionsofoffice,oriftheofficeoftheprincipalbecomesvacant,thevice-principalbecomestheactingprincipal.

    (6)Anactingprincipalhasthesamefunctionsastheprincipal.

    (3)Apersonmaybeappointedformorethanonetermofoffice.

11.  (1)Thecouncilappointsthevice-principalafterconsideringtherecommendationoftheprincipal.

    (4)Thevice-principalisfurtherresponsibleforanyspecificmanagerial,administrativeandsupervisoryfunctionsentrustedtohimorherbytheprincipal.

    (2)Thecouncildeterminesthefunctionsandthetermofofficeofadeputyvice-chancellor.

    (c)byelectronicmailorfacsimiletothepersonconcernedather/hisaddresslastknowntotheregistrar;and

    (d)byinternalUniversitymail.

    (2)Intheeventofthegivingofnoticebymeansofregisteredpost,theproductionbytheUniversityofareceiptbytherelevantpostalauthorityconstitutesprimafacieevidencethatthepersontowhomthenoticeisaddressedisdeemedtohavereceivedthenotice.

    Numericalfractions

    45.WhenevertherequirementsoftheStatuteortheRuleshavetheconsequenceofgeneratinganumberotherthananintegralnumber,thenextgreaterintegralnumberisheldtoconstitutethenumberinquestion.

    Personsinoffice

    46.PersonsholdingofficeundertheStatuterepealedbyparagraph47,aredeemed,withthenecessarychanges,tobeholdingofficeunderthecorrespondingprovisionsofthisStatuteunlessthisisinconsistentwiththisStatuteortheHigherEducationAct.

    RepealofpreviousStatute

    47.(1)TheStatuteapplicabletotheUniversityoftheWitwatersrand,Johannesburg,publishedbyGovernmentNoticeNo.1159of30September1999isherebyrepealedwitheffectfromthedateonwhichthisStatutecomesintooperation.

    (2)Notwithstandingsubparagraph(1)anystructureoftheUniversitywithinthemeaningoftheHigherEducationAct,whichexistedpriortothepublicationofthisStatute,continuestoexistandfunctionuntilthedaywheneachnewstructure,reconstitutedintermsofthisStatute,becomesfunctional.

    Transitionalprovisions

    48.(1)Anythingdoneunderany-provisionoftheUniversityoftheWitwatersrand,Johannesburg,(Private)Act,1959,beforethisStatutecameintooperation,isdeemedtohavebeendoneunderthecorrespondingprovisionofthisStatute.

    (2)Thecouncil,thesenateandtheuniversityforumwhichexistedatthecommencementofthisStatutecontinuetoexistinsofarastheyareconsistentwiththeprovisionsofthisStatuteandtheHigherEducationAct.

    (3)TheexistingregulationspromulgatedintermsoftheUniversitiesActNo61of1955whichwereinforceatthecommencementoftheHigherEducationActcontinuetoapplyuntilreplacedbyanyprovisionoftheStatuteoranyrulethatmaybemadeintermsofit.
